The National Network Data Management Regulations will come into effect on January 1, 2025. Compared to the draft征求意见稿 released three years ago:
All of the following provisions have been deleted:
- The establishment of a data security gateway to block foreign data information;
- The prohibition of providing tools services for surfing proxies and their penalty rules.
- A requirement that data handlers must respond to the request to transfer personal information with "technical feasibility".
- The restriction that data handlers must delete or anonymize personal information within 15 working days.
- The ban on using biometric identification as the sole authentication method.
- The broadening of the regulation from "large platform should not arbitrarily limit users' access to other platforms" to "large platform should not arbitrarily limit users' access to the data they generate."
